
"MICROSOFT SHAREPOINT PRODUCTS AND TECHNOLOGIES WEB PART DEVELOPMENT CONTEST" OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST.
The "MICROSOFT SHAREPOINT PRODUCTS AND TECHNOLOGIES WEB PART DEVELOPMENT CONTEST" ("Contest") starts at 12:00:01 am Pacific Daylight Time (PDT) on 5/12/03 & ends at 11:59:59 pm (PDT) on 7/31/03. The Sponsors of this Contest are Fawcette Technical Publications, 913 Emerson St. Palo Alto, CA 94301 and Microsoft Corporation, One Microsoft Way, Redmond, WA 98052 ("Sponsors").
The object of the contest is to create and submit a "Web Part" application which illustrates the capabilities of Microsoft SharePoint Products and Technologies.
ELIGIBILITY. This Contest is only open to legal residents of the United States and Canada (except residents of the Province of Quebec), 19 years of age or older. Employees and their immediate families (defined as parents, children, siblings, spouse, and life or domestic partners) of the Sponsors, West Coast Marketing, a division of The Susquehanna Hat Company ("West Coast Marketing"), their respective affiliates, subsidiaries, parent and related companies, agencies and judging panel (collectively, the "Promotion Parties"), and those living in the same households of same, are not eligible. This Contest is void where prohibited or restricted by law. By entering, entrants agree that they have read these Official Rules and to abide by and be bound by all terms of these Official Rules.
HOW TO ENTER: Beginning at 12:00:01 am Pacific Daylight Time (PDT) on 5/12/03 and continuing until 11:59:59 pm (PDT) on 7/31/03 you may enter as follows: log on to the web site at http://www.microsoft.com/sharepoint/webparts ("Entry Web Site") and follow the entry instructions posted: provide your name, address, company name (if applicable), telephone number, date of birth, Web Part name, description of exactly what the Web Part does, Web Part code (if desired), and represent that you own the rights to the code that you are submitting in your entry. Using the developer resources for Microsoft SharePoint Products and Technologies (available free at http://msdn.microsoft.com/sharepoint), submit your application using the submission tool at http://www.microsoft.com/sharepoint/webparts (also accessible from http://www.webpartdevcontest.com).
The Microsoft SharePoint Products and Technologies developer resources are available only online.
YOU MAY SUBMIT MULTIPLE ENTRIES FOR THIS CONTEST, HOWEVER, EACH ENTRY MUST BE DIFFERENT AND SUBMITTED SEPARATELY.
ALL ENTRIES MUST BE RECEIVED BY 11:59:59 PM (PDT) ON 7/31/03.
By entering, entrants agree that the the Promotion Parties, their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Entry Web Site or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; typographical, printing or other errors; or any combination thereof. Proof of submitting entry at an Entry Web Site is not considered proof of delivery or receipt. Illegible, incomplete, mechanically reproduced and duplicate entries will be disqualified. All entries become the property of the Sponsors and will not be returned or acknowledged. False and/or deceptive entries or acts shall render entrants ineligible. By registering to enter the Contest, entrant affirms that they have read and accepted these Official Contest Rules. The Contest shall be governed by and construed in accordance with the laws of the United States. By entering the Contest, entrants hereby submit to the jurisdiction and venue of the federal and state courts of the United States and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Official Contest Rules and with the Fawcette Technical Publications Online Privacy Policy, which can be found at https://ftponline.com/portals/microsoft/office/privacy/
WINNER SELECTION: All eligible entries received within the Entry Period will be judged equally according to the following three (3) criteria: (#1) Business Applicability (example: does it solve a real-world business problem? Does it present a return on investment to the company? Is it useful or interesting? Does it solve a technical challenge?), (#2) Technical Sophistication (example: does it work? Does it use new and existing technologies, platforms and hardware in interesting and innovative ways?) and (#3) Use of Microsoft SharePoint Products and Technologies tools and functionality (does it effectively use the technologies and capabilities? - does it leverage the SharePoint platform?). All judging will be done by a panel of qualified judges made up of editors of .NET Magazine/Visual Studio Magazine, authors/consultants and other industry experts from the computer industry, technical employees of Microsoft and will be under the auspices of West Coast Marketing. All judging is scheduled to be completed by 8/15/03. All entries are subject to review and approval by Sponsors' legal counsel. Any entry that Sponsors' legal counsel determines is inappropriate to be posted on Sponsors' web sites, published in an upcoming issue of Visual Studio Magazine and .NET Magazine or otherwise fails to meet criteria established by Sponsors (including, without limitation, due to technical, legal or other clearance problems) will be disqualified. The entry judged to have achieved the highest total score according to the above-specified criteria that has not been disqualified by Sponsor's legal counsel shall be declared the First Prize winner. The entry judged to have achieved the second highest total score according to the above-specified criteria, that has not been disqualified by Sponsor's legal counsel shall be declared the Second Prize winner. The entry judged to have achieved the third highest total score according to the above-specified criteria, that has not been disqualified by Sponsor's legal counsel shall be declared the Third Prize winner.
In the case of a tie score within any level of the judging process, the winner will be determined as follows: The winner with the highest score in criteria #1 will be declared the winner. If a tie continues, this tie-breaking process will continue thereafter to criteria #2 and criteria #3, in order, as needed, to break the tie. The Judges' decisions are final and binding with respect to all matters relating to this Contest. All prizes will be awarded given a qualified number of entries are received in each category. Winners will be notified by telephone, mail and/or e-mail by or about 08/22/03.
Winners will be required to execute and return an Affidavit of Eligibility/Release of Liability/Submission Release form, a completed IRS W-9 form or the comparable applicable tax form (for Canada winners), and (except where prohibited) a Publicity Release form within 14 days of date of issuance of notification.
By participating in the Contest, entrants certify that the entry they submit ("the submission") is the original design of the entrant, the entrant has full rights to the submission, that the submission has not been previously published, released or distributed, and that the submission does not infringe any third party rights and is suitable for publication as determined by Sponsor and/or judges in their sole discretion. Further, by participating in the contest, entrants grant to Sponsors, a royalty-free, non-exclusive, perpetual worldwide license to use their submission, or any element of the submission, in any and all media for the purpose of advertising and promoting Sponsor's website(s) and products without additional compensation. By entering, entrants agree to defend and indemnify Sponsors, their affiliates, subsidiaries, directors, officers, employees and agents from any and all liability, loss or damage of any kind, including legal fees, arising from or in connection with the exercise of the rights described above or participation in this Contest, or the acceptance, possession or use of any prize.
Failure to return all required documents within the deadline may result in the forfeiture of the prize and an alternate winner may be selected based on the criteria stated herein. Any winner notification or any prize returned to Sponsors or their fulfillment company as undeliverable for any reason will be awarded to an alternate winner, based on the criteria stated herein.. If an alternate selection is necessary for any reason, the entry with the next highest total score shall be declared the winner. Prizes will be delivered to winners within approximately 60 days of Sponsors' receipt and verification of Eligibility Affidavit/Release of Liability/Publicity and Submission Release Form and completed IRS W-9 form.
PRIZES: The following prizes will be awarded to the Prize winners as detailed above: FIRST PRIZE: (One [1] First Prize will be awarded): The First Prize shall consist of WINNERS CHOICE OF either a Compaq Tablet PC TC1000 (256K RAM,30GB hard drive, 802.11b integrated wireless LAN, 1-year warranty) <OR> a check in the amount of $1,799 as the complete and total prize. The ARV of the First Prize is $1,799.
SECOND PRIZE: (One [1] Second Prize will be awarded): The Second Prize shall consist of WINNERS CHOICE OF either one (1) hp iPAQ Pocket PC h5450, model 264493-001, <OR> a check in the amount of $699 as the complete and total prize. The ARV of the Second Prize is $699.
THIRD PRIZE: (One [1] Third Prize will be awarded): The Third Prize consists of WINNERS CHOICE OF either an HP Wireless Digital Media Receiver ew5000 <OR> a check in the amount of $299. as the complete and total prize. The ARV of the Third Prize is $299.
The total approximate retail value of all prizes to be awarded in this Contest is $2,797 (U.S.).
At Sponsors' discretion, all winning entries may be posted on the Entry Web Site and Microsoft web site, highlighted at trade shows/conferences and published in upcoming issues of Visual Studio Magazine and .NET Magazine without limitation or additional compensation to winner.. Acceptance of a prize constitutes permission (except where prohibited by law) for Sponsors and their designees to use winner's name, address (city and state only), voice, photograph, likeness, statements and submitted entry (and any version thereof) for advertising, promotional or publicity purposes worldwide, in any medium now known or hereafter created, without additional compensation or limitation. Sponsors and their respective designees may, but are not obligated to, use the original submission (including but not limited to any submitted code) by a winner or the final version as revised by Sponsor or its designees, or a combination or parts of either or both, on MSDN (Microsoft Developer Network) and/or in any other advertising or promotion medium Sponsors choose.
Only one prize will be awarded to any one household or individual. All details and features of prizes not set forth above shall be determined by Sponsors in their sole discretion. Prizes are not transferable or assignable. No substitution of a prize by the winner is permitted. All Federal, state, local or other taxes on prizes, if any, are the sole responsibility of winners.
GENERAL: This Contest is subject to all Federal, National, state, provincial and local laws and regulations. All entrants represent and warrant that any material that he or she submits is original with him or her, has not been previously published or won an award, does not infringe upon the copyright or any other right or interest of any other person or organization, and that the entrant has not previously granted any rights to such material to any other person or organization, nor does any third party have any interest in such materials. Sponsors reserve the right to alter, edit and/or recreate the Contest winners' entries in any way Sponsors desire. Sponsors and their designees may, but are not obligated to, use the original submission by the winners or the final version as revised by Sponsors or their designees, or a combination or parts of either or both, in any media now or hereafter known throughout the world without any further permission required from entrant or any third parties.
Entrants agree that Promotion Parties, their respective employees, officers, directors, shareholders, parent companies, affiliates, subsidiaries, agencies, judges and any other companies participating in the design, administration or fulfillment of this Contest, (collectively the "Contest Entities") shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from or in connection with participation or inability to participate in this Contest or acceptance of or use or inability to use the prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, misappropriation of personality, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winners release the Contest Entities from any and all liability and responsibility with respect to the prizes (including any property loss, damage, personal injury or death). Winners acknowledge that the aforementioned individuals and entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prizes, including but not limited to their quality, merchantability, mechanical condition, or fitness for a particular purpose.
If a prize cannot be awarded due to circumstances beyond the control of the Sponsors, a substitute prize of equal or greater retail value will be awarded at the discretion of the Sponsors. Contest Entities shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Contest Entities' sole control.
If for any reason this Contest is not capable of running as planned or does not allow the proper playing of the Contest and processing of entries per these rules, or if tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsors' sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action, and/or to terminate further entry in this Contest. In the event that termination of further entry in this Contest is made necessary as detailed above, all eligible entries received as of the termination date will be judged according to the judging criteria detailed above. If termination of this Contest occurs, notification will be posted on the web site at https://ftponline.com/. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
